Photography Services Agreement (Public Offer)

This Agreement serves as a public offer for photography services provided by Lisa (Elizaveta Peniaga) referred to as “Photographer”,  based in Chicago, IL. By submitting a deposit or full payment for any session via online checkout, invoice, or gift certificate, the client (referred to as “Client”) agrees to the terms outlined below.

1. Booking & Payment

• A session is considered booked only after a 50% non-refundable retainer is paid.
• The remaining balance is due on the day of the session, prior to the start of the shoot.
• Payments are processed securely via Stripe or PayPal. All payment data is handled directly by the respective platform — the Photographer does not store or access your card information.
• Gift cards or gift certificate redemptions must be confirmed at the time of booking. Purchased gift certificates are valid for 3 months from the date of purchase. All standard booking terms apply when scheduling a gifted session.

2. Rescheduling & Cancellations

• The retainer may be transferred to a new date only once, and only in the event of:
• Client illness
• Inclement weather (for outdoor sessions)
• Other cancellations or no-shows will result in the loss of the retainer. A new retainer will be required to rebook.
• Gift certificates are non-refundable and cannot be redeemed for cash.

3. Session Details

• Session duration is based on the selected package.
• Please plan to arrive on time, as late arrivals may shorten your session duration.

4. Image Delivery

• Edited images will be delivered via a private online gallery within the agreed turnaround time.
• The gallery will remain active for 3 months. After that, the Photographer is not obligated to store or re-upload files.
• RAW files are not included and will only be provided if purchased separately.

5. Image Usage & Copyright

• The Photographer retains copyright to all images and may use selected photos for portfolio, website, and promotional purposes unless otherwise agreed in writing prior to the session.
• Clients are granted personal, non-commercial rights to use and share the delivered images.
• The Photographer retains the right to publish and use selected images for portfolio display (including website and social media), advertising campaigns, magazine submissions, photography contests, and professional awards, unless the Client requests otherwise in writing prior to the session.

6. Editing & Style

• Client acknowledges they have reviewed the Photographer’s portfolio and editing style, and agrees to receive the final product in this artistic vision.
• No additional retouching or alterations may be made by the Client. This includes applying filters, altering body shapes, or editing facial features.

7. Online Payments & Security

• Payments are processed via third-party providers (Stripe or PayPal) in compliance with industry-standard encryption and data protection.
• By completing an online transaction, the Client agrees to this Agreement and any relevant Refund and Payment Policies shown at checkout.
• In the case of a chargeback or payment dispute, the Photographer reserves the right to cancel services and retain all delivered work until resolved.

8. Acceptance of Terms

This Agreement is automatically accepted upon payment of the retainer, full session amount, or redemption of a gift certificate.Any updates to this Agreement will be reflected on this page. It is the Client’s responsibility to review the terms prior to booking.
